All orders on the PACHAMAMA website are subject to these general conditions of sale.
Application of the general conditions of sale
The general conditions of sale described below detail the rights and obligations of PACHAMAMA and its customer in connection with the sale of PACHAMAMA bags.
The Customer must be aware of the terms and conditions prior to any order, the terms and conditions being available on the Site.
PACHAMAMA reserves the right to adapt or modify these Terms and Conditions at any time, the version of the Terms and Conditions applicable to any sale being the one appearing online on https://www.pachamama-handcraft.com/ at the time of ordering.
Consequently, placing an order requires full and unconditional adherence to these terms and conditions by the customer, who by definition accepts the general terms and conditions of sale.
Site Information and Site Accessibility
https://www.pachamama-handcraft.com/ is an e-commerce site owned and operated by PACHAMAMA.
The Site is open to all users of the internet network by principle accessible 24/7/7, unless interruption, programmed or not, by PACHAMAMA or its service providers, for the purposes of its maintenance or in case of force majeure. PACHAMAMA shall not be liable for any damage, whatever its nature, resulting from an unavailability of the Site.
PACHAMAMA does not guarantee that the Site will be free of anomalies, errors or bugs, nor that the Site will operate without failure or interruption. In this regard, it may freely and at its sole discretion determine any period of unavailability of the Site or its content. PACHAMAMA cannot be held responsible for data transmission, connection or network unavailability problems.
The products offered for sale are those described on the Site on the day of the Customer’s consultation of the Site, subject to the availability of stocks.
PACHAMAMA reserves the right to withdraw products from sale at any time.
Pachamama takes the utmost care in the presentation and description of these products to best satisfy the Customer’s information. However, it is possible that errors may appear on the Site, which the Customer acknowledges and accepts.
Thus, the photographs on the site are the most accurate possible but cannot ensure a perfect similarity with the product offered, especially with regard to colours.
The prices of the goods sold are those in force on the date of the order. They are denominated in euros and calculated all taxes included.
Prices quoted include order processing fees, but do not include transportation and delivery costs.
PACHAMAMA grants itself the right to change its tariffs at any time. However, it undertakes to charge the goods ordered at the prices indicated when the order is registered.
The order taking on the Site is subject to compliance with the procedure set up by PACHAMAMA on the site including successive steps leading to the validation of the Order.
The Customer may select as many Products as he wishes that will be added to the basket. The Basket summarizes the Products chosen by the Customer as well as the prices. The Customer may freely modify the Basket before validation of its Order.
Once the choice of Products has been made, and the basket has been validated, the customer must:
- Complete the registration form with all required contact information;
- Check his order
- Make the payment in the manner provided;
- Confirm its order and payment.
Any order shall constitute express and irrevocable acceptance of the prices and descriptions of the products available for sale. The validation of the order by the CUSTOMER is the acceptance of the general conditions of sale.
All the data provided and the recorded confirmation will be proof of the transaction. The confirmation will be considered as signature and acceptance of the transactions carried out.
The seller will communicate by email confirmation of the registered order.
Method of payment
Online payment is made by credit card (credit card, visa, mastercard) or by using a Paypal payment account. The customer certifies that he is the holder of the credit card or Paypal account used to pay for the items.
When making an order, the buyer must pay the products entirely to have his order validated and sent.
PACHAMAMA retains ownership of the goods sold until full payment of the price. PACHAMAMA will not be required to deliver the Products ordered by the Customer if the price has not been paid in full beforehand.

For any order placed before 10am of a product in stock, Pachamama processes and ships your order on the same day (excluding WE).
For any order placed after 10am of a product in stock, Pachamama will process and ship your order the next day (excluding WE).
From the date of shipping:
In mainland France, your parcel will be delivered in 4/5 days with the Mondial Relay delivery service, in 2/3 days with the Colissimo delivery service and in 24h with the Express Chronopost delivery service.
In Europe, your parcel will be delivered in 3/5 days.
In the rest of the world, your parcel will be delivered in one week.
You will be informed by mail of the delivery of your package, with a tracking number.

FOR LEATHER GOODS:
The delivery costs are FREE from 70€ of purchase with Mondial Relay delivery.
Under 70€ of purchase, the delievery fee for Mondial Relay delivery is 5€.
The delivery fee for Colissimo delivery is 5€.
The delivery fee for Chronopost express delivery is 15€.

- FREE: Mondial Relay delivery in metropolitan France

- €9: Belgium, Germany, Spain, Italy, Luxembourg, Netherlands, Portugal

- 35€ in the rest of the world.
In the case of a delivery outside the European Union, the delivery charges do not include any customs duties and taxes to be paid by the customer. The amount of these taxes depends on the country of destination, the customer must contact the local authorities in order to respect the import costs of goods inherent to his place of receipt of order.
The package is hand delivered or delivered to your mailbox. If the size of the mailbox is too small to deliver the package, it will be made available to you in the post office to which you are attached. You will have 14 working days since the arrival of the package at the post office to pick it up. After this time, it will be returned to the sender.
The delivery time indicated when the order is recorded is given only for information purposes and is not guaranteed.
The exceeding of these deadlines may in no case be held against PACHAMAMA, nor give rise to a termination of the contract or to any indemnity for damages.
If an article or several articles are not suitable, the CUSTOMER has 15 days from the date of receipt of the goods to exchange the product(s) purchased by another model of the same value, subject to the available stock limit.
What is the procedure ?

Returns must be done in the original packaging and in their original state (accessories, etc.).
The return of the product must be paid by the customer and the new delivery is offered by Pachamama.
All products returned must be in a perfect state, non used and non washed. At the reception of the product, Pachmama will judge of the state of the product. No returns will be accepted if returned products have been obviously used, damaged or dirty.
Once we have received and verified the good condition of your products, we will deliver you the exchange product(s). A confirmation email with the package tracking code will be sent to you.
Obligation of the parties
PACHAMAMA, in the event of acceptance of an order, undertakes to sell and deliver to the CUSTOMER the product(s) ordered in accordance with the conditions specified above.
The CUSTOMER undertakes to provide PACHAMAMA with an address at which delivery can be made.
Filling the personal informations (name, address, telephone, e-mail address, etc.) for the purpose of concluding the sales contract is mandatory.
This information is essential to process and deliver the orders and to prepare the invoices.
In the event of an error in the provision of this information, PACHAMAMA cannot be held responsible for the impossibility of delivering the product. In this case, the CUSTOMER remains responsible for the payment. In the event of an incomplete address being supplied, which means that the transport provider is unable to deliver, the CUSTOMER will have to pay the delivery costs corresponding to the re-dispatch of his order.
All our products benefit from the legal guarantee provided by Articles 1641 and followings of the Civil Code and articles L. 211-4 and followings of the Consumer Code, provided that the use was normal and care instructions were followed.
In case of non-compliance of a product sold, it can be returned to the seller who will take it back and exchange it.

All claims and trade requests must be made within 15 days of receipt of the goods.
All our products pass a quality test. However, the customer has 4 months after receiving the package to write to PACHAMAMA if there is a manufacturing defect at firstname.lastname@example.org. The warranty does not take into account the damage caused by clumsiness or abuse of the customer. Only PACHAMAMA will have the authority to determine whether the product is covered by the warranty or not.
The collect of the CLIENT’s personal data is necessary to process the order. This information is strictly confidential and only for the use of PACHAMAMA. In accordance with the Data Protection and Freedom Law of 6 January 1978, the CUSTOMER has the right to access, modify, correct and delete personal data concerning him. If the CUSTOMER wishes to exercise this right, he only has to write to PACHAMAMA, indicating his name, first name and address.

You can refuse to register Cookies by adjusting your Internet browser settings. Legal – Applicable Law
The liability of PACHAMAMA cannot be implemented if the non-execution or delay in the execution of one of its obligations described in these General Terms and Conditions of Sale results from a case of force majeure. As such, force majeure means any external event, unpredictable and irresistible within the meaning of Article 1148 of the Civil Code.
The invalidity or unenforceability of any of the clauses of these general conditions of sale shall not affect the application or validity of the other clauses of the general conditions of sale. This clause will then be replaced by the closest possible provision.
These general conditions are subject to French law as regards the substantive rules as well as the formal rules. Any dispute must be the subject of a prior attempt at an amicable settlement.
In the absence of an amicable resolution, the dispute will be brought before the competent French Commercial Court.
